This case has standing, there is a demonstrably harmed party should the electoral college proceed as matters currently stand, it can't be filed at the state level because the defendants are themselves states, and it is constitutionally sound and has merit. Texas doesn't need to prove fraud to win, it just needs to successfully argue the Constitution and its amendments were violated in the four defendant states. It was filed a minute before midnight on the 7th, to raise ongoing dispute and freeze out safe harbor. This one could and should succeed on the merits, we'll need to see if the supreme court will accept such a political grenade.
