Because one case is use of racist terms, the other is action likely to cause a breach of the peace or something like that and therefore carries a higher penalty.

from what i read of the case today, terry has admitted saying black **** but its coming down to who's version of events you belive. terrys that he said it sarcastically or ferdinands that he made a racist slur.

is this right or have i got this wrong as per normal?

Terry racially abused him but for all the right reasons?
