He didn't activate the release clause. That expired a month before the deadline. Moyes paid around £3m more than he needed to. But the fact that he didn't get him with his release clause early on and instead pursued lost causes in Thiago and Fabregas tells you what you need to know. Even Moyes didn't want Fellaini - he just needed to desperately get something in at the end.
