One article states for the release clause to be valid you have to show you have agreed personal terms with the player or at least pretty much done.

I dont think you can just pay a release clause without dome agreement in place with player otherwise could be chaos

Sky says you have to slap the money down with the Spanish authorities to trigger the release. But if we've already negotiated a deal with the player, isn't that classic tapping-up?
